Terms & Conditions

Welcome to Text Marketing Club (“we,” “us,” “our”), a service operated as a sister concern of Onex Solutions Pvt. Ltd. By using our services, you (“User,” “Client,” or “you”) agree to be bound by the following Terms & Conditions. If you do not agree to these terms, please do not use our services.

1. Services Provided

Text Marketing Club offers SMS and text message marketing services that allow businesses to send promotional and transactional messages to their customers.

2. Eligibility

By using our services, you confirm that you are at least 18 years old and authorized to represent the business you are registering on behalf of.

3. Account Registration

You may be required to create an account and provide accurate contact and business information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

4. Acceptable Use

You agree not to:

Use the service for spam, illegal, fraudulent, or abusive purposes.
Send messages without the recipient's consent (opt-in).
Violate applicable laws including data protection and telecom regulations.
Interfere with or disrupt the integrity or performance of our platform.

We reserve the right to suspend or terminate your account for violations.

5. Message Content & Compliance

You are solely responsible for the content of the messages you send and for ensuring compliance with applicable laws (including TRAI, TCPA, etc.).

You represent and warrant that:

All recipients have given proper consent.
Content does not include prohibited material such as hate speech, misinformation, or unauthorized advertising.
You will include opt-out instructions where required.

6. Fees & Payment

Fees for services are outlined at the time of purchase or in your service agreement.
All payments are non-refundable unless otherwise specified.
We reserve the right to suspend services for overdue accounts.

7. Intellectual Property

All content, trademarks, and technology associated with the platform are the property of Text Marketing Club or its licensors. You may not copy, modify, or distribute any part of the service without written permission.

8. Limitation of Liability

We shall not be liable for:

Indirect, incidental, or consequential damages.
Loss of business or profits.
Delays or failures in message delivery due to telecom providers or technical errors.

Our maximum liability shall not exceed the amount you paid us in the last 30 days prior to the claim.

9. Termination

We may suspend or terminate your access to the service at any time for any reason, including breach of these Terms. You may also cancel your account at any time.

10. Privacy

Your use of the service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data.

11. Governing Law

These Terms are governed by the laws of India, Kolkata. Any disputes shall be resolved in the courts located in Kolkata.

12. Modifications

We reserve the right to update or modify these Terms at any time. Continued use of the service after changes implies your acceptance.
